AUSTRALIAN NATIONAL SADDLEHORSE ASSOCIATION Inc. REGULATIONS

 

1. These regulations have been made in accordance with Clause 25 of the Constitution of the Australian National Saddlehorse Association Inc. They shall not be varied by means of excision, additions or deletion or by any other means unless:

 

1.1 A notice of intention to move a resolution together with details of the resolution is lodged in writing with the Secretary at least 30 days before the meeting of the Management Council at which it will be considered.

 

1.2        The Secretary includes details of the notice and of the resolution in the notice convening the meeting.

 

1.3 The resolution or one substantially similar to it, is carried by at least three fifths of the votes cast at the meeting of which due notice has been given.

 

2.        Any question relating to the Association on which theses regulations are silent shall be determined by the Management Council.

 

3.        DEFINITIONS. In this document the undermentioned words or combination of words shall have the meanings applied to them respectively:

 

3.1        ASSOCIATION. Is the Australian National Saddlehorse Association Inc known briefly as 'Ansa'.

 

3.2        SECRETARY. Is the person appointedd by the Council in pursuance of the requirements of the Associations Incorporation Act 1981.

 

3.3 MANAGEMENT COUNCIL. Is the Management Council of the Australian National Saddlehorse Association Inc. within the meaning of Section 32 of the Associations Incorporation Act.

 

3.4        COUNCILLOR. Is a member of the Management Council of the Association.

 

3.5        MEMBER. Is a person registered in the records of the Association as a member of the Association, being either an ordinary member, junior member, or honorary life member of other type approved by the Association.

 

3.6        FINANCIAL MEMBER. Is a member who has paid to the Association all annual membership fees due and payable for such member. Other fees and charges shall be paid according to the requirements of the Association, but late payment of them alone shall not render a member unfinancial.

           3.7         BREEDER of a horse is the owner or lessee of the dam of such horse at the time of the service which resulted in the birth of the horse.

 

3.8        OWNER of a horse is the person for the time being registered as the owner in the records of the Association, and shall be identical with the name in which the membership exists in the records of the Association.

 

            3.9       CLASSIFICATION is the process of inspection of horses, the owners of which have applied for the admittance of their horse to the Register of any other records of the Association. A horse may be admitted or rejected.

 

3.10     REGISTERED HORSE is one which has been inspected by a panel of     three duly appointed classifiers who have recommended that the horse be admitted. A horse shall be considered registered after being passed and all the necessary fees are paid.

 

3.11 AGE (a) In order to be co-operative with activities such as Show classes and breeding records the age of a horse shall be reckoned from the first day of August in the year in which it is foaled on or after that day. If foaled before that day it shall be reckoned from the first day of August in the previous year.

(b) For all other purposes, such a minimum age for classification, the age of the horse shall be calculated from the actual date of birth.

 

3.12      COLT An uncastrated male under the age of four years. Common   abbreviation" C ".

 

3.13 STALLION An uncastrated male four years old and over. Common abbreviation" S"

 

3.14 FILLY A female under the age of four years.Common abbreviation "F"

 

3.15 MARE A female four years old and over. Common abbreviation "M".

 

3.16 GELDING A castrated male of any age. Common abbreviation "G".

 

3.17 FOAL RECORDING is the process by which a foal is recorded with the Association by the owner of the dam at the time of foaling. A foal cannot be considered as foal recorded until a number has been allocated. It MUST be presented subsequently for classification inspection for registration

 

3.18 BREEDING RETURNS is the period commencing on first of August in any year and ending on 31 st of July in the succeeding year. Thus the period 1.8.92 to 31.7.93 is known as the 1992 breeding year.

 

3.19 YEAR NUMBER in relation to a horse shall be the last numeral of the breeding year in which it was born. Thus the "year number" for the breeding year 1992 is 2 and so on.

 



3.20 BREEDING RETURNS The term used to cover documents required to be submitted to the Association by a member/breeder containing breeding operation details required for the preparation and publication of the Ansa register and similar matter.

 

3.21 "Financial Year" The accounting period at the end of which the financial records of the Association are audited for report to members. The period may vary to meet the requirements of the organisation. For the Association the financial year is synonymous with the Calendar year, namely 1 st January to 31 st December each year.

 

3.22 IN WRITING and WRITTEN include printing, lithography and other modes of reproducing or representing words in visible form.

 

3.23 REGULATION means Rules and By-Laws of the Association in accordance with the Constitution in force for the time being and referred to in 1 hereof.

 

3.24 SUSPENSION A state which may be defined and imposed by the Association and during which all rights, privileges and transactions are held in abeyance pending some course of action to be outlined at the time.

 

3.25 DISQUALIFICATION A penalty which may be defined and imposed by the Management Council.

 

4. GENERAL ADMINISTRATION. Where the context reasonably permits, the singular number includes the plural number and vice-versa. Words implying the masculine gender include the feminine and neuter genders, and words implying persons include corporations, companies and partnerships

 

5.         MEMBERSHIP

 

5.1        The annual fees for members of the Association may be varied by the Management Council

 

5.2 A new member who joins between 1 st October and 31 st December in any one year, shall remain financial until 31 st December in the next succeeding year.

 

5.3 Life Membership is an honorary award made only on recommendation of the Council to an Annual General Meeting, for meritorious service to the Association.

 

5.4        Members in arrears will be re-admitted at the normal membership rates per year with no discount permitted.

 

5.5        A member must remain a financial member of the Association to receive the services and privileges that it offer

7. ARREARS IN FEES. Where a member is in arrears with any monies due to the Association whether they be membership, registration or other fees or any monies whatsoever, the Association has power to discontinue any transactions with that person until such arrears are paid.

 

8. JUDGES. The Association shall compile and maintain a panel of judges for Ansa horses and may from time to time alter the panel by addition, deletion or otherwise. The panel of judges is issued separately periodically.

 

9.         ANSA CLASSES IN SHOWS SPONSORED BY THE ASSOCIATION

 

9.1        Any horse registered or foal recorded with the Association shall be eligible to compete in any classes provided the owner is a financial member at the time of entry. Proof of registration must be produced if required.

 

9.1.1     Foal recorded horses are only eligible to compete up to 4 years.

 

9.2        Foal recorded horses which qualify in their class will be eligible to compete for championship awards.

 

9.3         The Association should encourage Show Societies to implement these attitudes, but cannot enforce them.

 

10. CLASSIFICATION

 

10.1 Any person being nominated as a classifier must be nominated from a Branch meeting, or in the event that no Branch exists in a particular area, a classifier may be nominated by two financial members.

 

10.2 A panel of three classifiers must be present at the inspection of every horse submitted for examination, and no horse shall be admitted to the Register unless it has been recommended by such a panel.

Classifiers shall NOT award points but shall indicate their approval or otherwise by comment.

 

10.3 The Council shall elect a Central Classification Committee, whose members need not be members of the Council, as the need arises. Such Committee shall have power to over-rule decisions made by panels of classifiers covered by 10.2 herein.

 

10.4 A classifier may not participate in the inspection for classification of any horse which he owns or in which he has a pecuniary interest or any other direct interest.

 

10.5 In the event of a horse being rejected at the primary classification inspection, the owner may appeal to the Council for re-consideration of the classification on the following basis:

 

10.5.1If the rejection was of a young horse on the grounds of lack of development or education - the horse may be resubmitted after the lapse of a period at the discretion of the classifiers. it shall be preferable for the re-inspection to be done by all three original classifiers, but if this is impracticable then at least one original classifier must be present. Should the horse be rejected again at this second inspection, an appeal may be lodged as in 10.5.2

 

10.5.2The owner of a mature horse rejected at an initial inspection or of a young horse rejected after a second inspection, may appeal to the secretary in writing within 30 days of the date of inspection stating the grounds for appeal and accompanied by a deposit of $100.00

 

10.5.30n receipt of appeal, the Council shall decide what action, if any, shall be taken. Depending on this decision, the following shall apply:

 

10.5.3.1 If the horse is again inspected and rejected, the owner forfeits the $100 deposit and pays any further amount decided upon prior to the final inspection

10.5.3. 2Should the horse on the second inspection be accepted, the deposit of $100 is refunded less the full registration and inspection fees applicable. If a stallion is involved, the owner will pay the difference between the $100 deposit and the total registration and inspection fees applicable.

 

10.6 An inspection of a horse for the purpose of classification may be made at any time after the horse has reached two years of age from the date of birth, at the discretion of the panel of classifiers.

 

10.7 At classification inspections all horses must be ridden except in exceptional circumstances. Classifiers shall determine when these circumstances exist and when the requirement may be waived. The circumstances will normally be confined to aged mares in foal, other mares heavily in foal, and the odd case of a horse with very special qualifications, but suffering a disability which makes riding undesirable.

 

10.8 Classifiers will refrain from riding horses submitted for classification.

 

10.9 Should a horse being classified for registration having been foal recorded and by breeding background, be eligible for admission subsequently to a Stud Book, the classifiers may endorse the classification inspection form accordingly, provided it reaches Stud Book standard.

11. REGISTRATION OF HORSES

11.1 The Council may accept or refuse any application for registration without assigning a reason.

 

11. L 1 Publication of any Register or Stud Book be deferred until office organisation and finances are adequate.

 

11.2 In order to qualify for registration with Ansa, a horse must be submitted for classification inspection as detailed elsewhere herein and must attain the required standard of excellence.

 

11.3 Upon acceptance of a horse for registration, an appropriate number shall be allotted and a Certificate of Registration shall be supplied to the owner.

 

11.4 The owner must be a financial member in order to have a horse registered or foal recorded with the Association.

 

11.5 A horse got by artificial insemination shall be accepted for registration with the Association.

 


12. NAMING OF HORSES

12.1 Horses names should be no longer than thirty letter spacings. Unless a stud prefix is used, alternative names shall be shown in the space provided w
